Refund Policy

This Refund Policy (the “Policy”) sets forth the terms and conditions governing the eligibility, processing, and limitations of refunds for the services and products offered by Aicountly (hereinafter referred to as “Aicountly,” “we,” “our,” or “us”) through the Aicountly Platform (the “Platform”). This Policy forms an integral part of our Terms of Service and is governed by the applicable laws of India.

By subscribing to, purchasing, or using any of Aicountly’s services and products, the User (“Customer,” “Subscriber,” or “You”) acknowledges and expressly agrees to the terms stipulated herein.

Eligibility for Refunds

Refunds shall only be granted in strict compliance with the following conditions:

• Time Limitation: The Customer must submit a refund request within the prescribed time frame from the date of purchase, subscription, or renewal.
• Product Activation & Usage:Refund requests shall only be entertained if the product or service has not been fully activated, utilized, or accessed by the Customer, subject to the exclusions set forth below.
• Partial Usage Exclusion: If the Customer has accessed any portion of the service, utilized any features, or derived any benefit from the service, no refund shall be granted.

Aicountly reserves the sole and absolute discretion to assess refund eligibility based on the extent of service usage.

Subscription Cancellation and Refund Conditions

Refunds for subscription cancellations shall be processed strictly in accordance with the following terms:

Service Termination Within 15 Days:

• If the Customer cancels their subscription within 15 calendar days from the purchase date, they shall be entitled to a full refund of the subscription fee.
• Any applicable GST charges shall be reversed in accordance with the Goods and Services Tax Act, 2017.

Service Termination After 15 Days:

• No refund shall be processed for requests made beyond the 15-day period from the date of purchase.

Refund Request Procedure

All refund requests must be formally submitted via email to support@aicountly.com and must include the following mandatory details:

• Full name and contact information of the Customer
• Order details (subscription date, product/service purchased)
• Transaction reference number and amount paid
• Detailed reason for the refund request, supported by relevant documentation (if applicable)

Failure to provide adequate information may result in the rejection of the refund request. Aicountly reserves the right to seek additional details or clarification before processing a refund.

Refund for Service Modifications & Returns

A refund request may be entertained if Aicountly modifies, suspends, or discontinues a feature or functionality of the subscribed service, provided that:

• Such modification materially affects the core functionality of the service.
• Aicountly is unable to resolve the issue within a reasonable period.

Refunds Shall Not Be Issued If:

• The modification is part of a routine service enhancement or feature update.
• The modification is a result of external factors beyond Aicountly’s control, including but not limited to regulatory changes or third-party service restrictions.

Customization & Non-Refundable Products

Refunds shall not be granted for any services involving customization, bespoke development, or feature modifications specifically requested by the Customer.

By engaging Aicountly for customization, the Customer expressly acknowledges that:

• Payments made for customization are final and non-refundable.
• Additional charges for custom development, integrations, or enhancements shall not be refundable under any circumstances

Auto-Renewal and Cancellation

Aicountly operates an auto-renewal system to ensure continuous service access. The following conditions apply to auto-renewals:

Auto-Renewal Terms:

• Customers shall receive prior notification regarding the renewal and applicable charges.
• The renewal fee shall be automatically charged using the designated payment method.

Refunds for auto-renewals shall be processed using the original payment method and in compliance with applicable Reserve Bank of India (RBI) regulations and the Payment and Settlement Systems Act, 2007.

• Customers are solely responsible for disabling auto-renewal in their account settings before the renewal date if they do not wish to continue their subscription.

Exceptions to Refunds

Aicountly shall not issue refunds in the following circumstances:

i. Breach of Terms of Service:

• If a Customer’s account is suspended or terminated due to a violation of Aicountly’s Terms of Service, no refund shall be provided.

ii. Chargebacks & Payment Disputes:

• If a Customer initiates a chargeback, payment dispute, or reversal, Aicountly reserves the right to suspend or terminate access to all services until the matter is resolved.

iii. Unapproved Use & Unauthorized Transactions:

• If the Customer has accessed, activated, or used the service beyond a reasonable trial or evaluation period, no refund shall be granted.

iv. Change of Mind:

• Refund requests based solely on a Customer’s change of mind after activation or usage shall not be entertained.

v. Force Majeure Events:

• Aicountly shall not be liable to issue refunds or compensation for service interruptions or failures due to unforeseen events beyond its control, including but not limited to natural disasters, governmental actions, cyber-attacks, or third-party service failures.

Grievance Redressal Mechanism

If a Customer is dissatisfied with the outcome of their refund request, they may escalate the matter as follows:

• First Level: Contact Customer Support at support@aicountly.com.
• Second Level: If unresolved, escalate to the Grievance Officer at grievance@sispl.org.
• Final Level: If still unresolved, escalate to the Nodal Officer at nodalofficer@sispl.org for a final resolution.

All grievance escalation requests must include:

• Full name and contact details
• Transaction details (purchase date, amount, product/service)
• A detailed description of the complaint

9. Governing Law & Jurisdiction

This Refund Policy shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising under or in connection with this Policy shall be subject to the exclusive jurisdiction of the competent courts in Chandigarh, India.

10. Amendments to the Refund Policy

Aicountly reserves the absolute right to modify, revise, or amend this Refund Policy at its sole discretion, without prior notice. Any such modifications shall be effective immediately upon being published on the Platform.

Continued use of Aicountly’s services following such modifications shall constitute the Customer’s acceptance of the revised Policy.
